Terms of engagement.
The shape of the relationship in plain English. The full version of any engagement we sign together is a separate written agreement.
About these terms
These terms cover your use of blackgeekltd.com and the general shape of any engagement with Blackgeek Ltd, a private limited company registered in England and Wales under company number 07337347, VAT registration GB 133 3206 57, with its registered office at 10 Riverside Business Park, Lyon Road, London SW19 2RL, United Kingdom.
The legally binding document for a specific project is the written proposal we send and you countersign — these terms govern only the website and the initial contact. By using the site you accept these terms.
Use of the site
You may view, link to, and excerpt the site for personal or editorial purposes. You may not scrape it at high volume, reverse-engineer the design system to resell, pass it off as your own, or use it to train commercial models without our written consent. Case studies and writing on the site are © Blackgeek Ltd; client logos and project visuals belong to their respective owners and are used here with permission.
Briefs you send us
When you submit a brief through the contact form you grant us a limited, non-exclusive licence to read it, discuss it internally, and reply. We don't pass it on to third parties. If we decline the work we delete the brief within 90 days unless you tell us otherwise. See the privacy notice for retention details.
The brief itself is not a contract — there is no engagement until we have both signed a written proposal.
Proposals, fees and scope
- Proposals are fixed-fee. The fee in the signed proposal is the fee for the agreed scope — we do not bill by the hour for the work in scope.
- If scope changes during an engagement, we write a short change note with the new fee and timeline before doing the additional work. Nothing is "true-up'd" silently.
- Payment terms are typically 50% on countersignature and 50% on delivery, unless your procurement requires a different cadence — say so up front.
- Travel, third-party software, photography, print and similar pass-through costs are billed at cost with the receipt attached.
Intellectual property
On full payment, copyright in the final deliverables we make for you transfers to you, with two reservations: (a) we retain the right to show the work in our portfolio and case studies — we'll ask before publishing anything sensitive; (b) underlying tools, components, and methods we developed before or during the work remain ours and may be reused. Anything we license in (fonts, stock, third-party code) is licensed to you under that vendor's terms.
Confidentiality
We treat your brief, materials, and any pre-publication strategy as confidential by default. An NDA is not required unless you'd prefer one — say so on the brief form and we'll countersign yours before the call.
Liability
Nothing in these terms excludes liability that cannot be excluded by law (e.g. for death or personal injury caused by negligence, or fraud). Subject to that, our aggregate liability for any matter arising from an engagement is limited to the fees paid for that engagement. We do not accept liability for loss of profit, opportunity, or data, except where required by law.
Suspension and termination
Either party can terminate an engagement with reasonable notice and payment for work done up to that point. We can suspend or refuse service if a brief or behaviour breaches these terms, applicable law, or our published values (e.g. work for gambling, fossil-fuel extraction, weapons, payday lending, or surveillance technology — we say no to those).
Professional advice scope
Blackgeek does not provide financial, investment, regulated brokerage, or legal/regulatory advice. We support marketing strategy, campaign architecture, attribution and performance operations — including for clients in regulated or high-compliance sectors such as financial services. Clients remain responsible for ensuring their products, offers and communications comply with applicable laws, platform policies, and regulatory requirements in their jurisdiction (including but not limited to the FCA, CySEC, ASIC, ESMA, and equivalents).
Examples and performance claims
Any examples, case studies, metrics, or performance references shown on this site are illustrative and do not guarantee future results. Engagement details may be abbreviated, anonymised, or NDA-protected. Final scope, deliverables, fees, and responsibilities are agreed in writing in the engagement proposal before work begins, and that proposal is the binding document for the project.
Governing law
These terms and any engagement are governed by the laws of England and Wales, and the courts of England have exclusive jurisdiction.
